Is this some kind of joke, says SC on trial through Whatsapp

The Supreme Court took a serious note and said Is this some kind of joke on trial through whatsapp in the case of former minister of Jharkhand and his MLA wife. The lower court of Hazaribagh, Jharkhand had put the accused MLA and his wife on trial by pronouncing the order framing charges against them through whatsapp call.

The such case for the first time reached the top court which left wandering how this kind of joke can be allowed in court of India. It was unfortunate and bizzare to conduct any criminal case being conducted through instant messaging app Whatsapp.The Bench comprised of Justices SA Bobde and LN Rao took serious note and said , What is Happening in Jharkhand. This type of process cannot be allowed in administration of Justice.

The former Jharkhand Minister Yogendra Sao and his wife Nirmala Devi accused in rioting case of 2016. Both of them were granted bail by the top court last year and imposed condition that they shall stay in Bhopal and not enter Jharkhand except for attending the proceedings of Court. Both the accused the top court that on April 19 the lower court had framed charges against them through whatsapp despite they raise objection to it.

The top Bench issued the notice to Jharkhand Government on plea by both accused who requested to transfer the case from Hazaribagh to New Delhi and asked to respond within 2 weeks. The counsel of state told the Court that former MLA had violated Bail conditions and had been out of Bhopal many times due to which proceeding were delayed to which The Court replied that this is different issue and you can apply for cancellation of Bail by seperate application.
