The plea against the CBSE (Central Board of Secondary Education) was filed and requested to seek contempt action against board for allegedly Disobeying the Supreme Court order and charging exorbitant amount of fees. The court while hearing issued Notice to Educational Institution to respond within six weeks.

The Bench comprised of Justices Ranjan Gogoi, Navin Sinha and KM Joseph on Monday issued notice to CBSE on plea seeking contempt action against Board for allegedly disobeying the top court order and charging  exorbitant fees upto RS 1200 from students for obtaining copies of evaluated answer sheets.

The plea alleged that the Board got direction of Apex Court in 2016 and the court had said that Board should Scrupulously follow 2011 verdict. In 2011 verdict the court said students have fundamental right and legal right to access their evaluated answer sheets under RTI [Right to Information] act.

CBSE had published prescribing RS 1000 and Rs 1200 for 10th  and 12th to get the copy of evaluated answer sheets violating the Apex court order. The petitioner claimed as per court direction fee prescribed under 2012 RTI rules should be charged from students to obtain answer sheets and set aside the fee amount prescribed by CBSE.
